RULES AND REGULATIONS GOVERNING THE PROVISION OF ELECTRONIC SERVICES

General Provisions

  1. The Seller provides services in accordance with these Rules and Regulations and all applicable laws.
  2. The Shop's electronic services are available through its website 24 hours a day, 7 days a week.
  3. These Rules and Regulations are published on the Shop website and may also be made available through the Customer Account or attached to electronic correspondence relating to orders. Customers may access, download, save or print them at any time.
  4. Information presented on the Shop website does not constitute an offer within the meaning of Article 66 of the Polish Civil Code. It should be understood as an invitation to submit an offer in accordance with Article 71 of the Polish Civil Code.
  5. To use the Shop properly, the Customer must have a device with Internet access, an active email account and a correctly configured, current or immediately preceding version of Microsoft Edge, Mozilla Firefox, Google Chrome, Safari or Opera with JavaScript enabled.
  6. The Customer may incur Internet access or data transmission charges according to the agreement with their telecommunications provider.

Creating a Customer Account

  1. The Customer Account agreement is concluded for an indefinite period when the Seller confirms registration of the Account.
  2. The Account allows the Customer to access a dedicated panel and manage information relating to personal details and orders.
  3. Registration is voluntary and free of charge and is completed by submitting the registration form available through the Shop.
  4. The Customer must provide accurate, complete and up-to-date information in all required fields and any optional fields they choose to complete.
  5. Before registration is submitted, the Customer confirms acceptance of these Rules and Regulations by selecting the appropriate checkbox.
  6. The Customer may also voluntarily consent to processing of personal data for marketing purposes.
  7. Marketing activities may include sending commercial information to the Customer's contact details. Such consent may be withdrawn at any time.
  8. The registration form is submitted electronically through the Shop.
  9. The Account can be used after registration and successful login with the correct credentials.
  10. The Customer may terminate the Account agreement at any time without giving a reason by using the available Account functions or by contacting the Seller by email or traditional mail.

Basic Shop Functions

The Shop may provide Customers with functions including:

  • a contact form,
  • a Product search engine,
  • Product enquiries,
  • Product ratings and reviews,
  • sharing Product offers through social media.

To use the contact form, the Customer must complete the required fields and send the message to the Seller. The Seller will respond without unnecessary delay by email, telephone or through functions available within the Shop.

The Product search function allows Customers to search the Shop using keywords and, where available, additional search criteria.

Customers may use the Product enquiry option to request information about Product availability. The Seller will respond without unnecessary delay.

Product ratings may be submitted using the appropriate review form. The Customer may be required to provide a rating according to the scale available on the Shop.

Sharing Shop content through social-media services may require the Customer to hold an account with the relevant social-media platform.

Certain Shop functions may require registration and login to a Customer Account. The Seller may temporarily disable existing functions or introduce additional functionality.

Orders Placed Through the Shop

  1. Products may be ordered through the Shop website 24 hours a day, 7 days a week using the Basket.
  2. A Customer logged into an existing Customer Account may continue checkout as a registered Customer.
  3. A Customer who is not logged in may create a new Account, place an order without creating an Account, or log into an existing Account.
  4. During checkout, the Customer provides or selects billing details, delivery details, delivery method and payment method.
  5. Before the order is submitted, the Basket displays the total cost of the order, including applicable delivery and payment-related charges.
  6. Submitting the order constitutes an offer by the Customer to conclude a Sales Contract with the Seller for the Products included in the order.
  7. Before submitting the order, the Customer confirms acceptance of these Rules and Regulations.
  8. The Customer may request changes to the order until the Seller provides information confirming shipment of the Products.
  9. Changes may include cancelling all or part of the order, adding Products or modifying the delivery address.
  10. If circumstances prevent the Seller from fulfilling all or part of the order, the Customer will be informed without unnecessary delay by email or telephone.
  11. The Seller may propose cancellation of an unavailable part of the order with an appropriate recalculation or division of the order into separate deliveries.
  12. Where the Seller proposes modified terms, the Customer's acceptance of those terms is required to conclude the Sales Contract on the modified basis.
  13. The Seller confirms acceptance of the order by email without unnecessary delay.
  14. The Sales Contract is concluded when the Seller confirms acceptance of the Customer's order.

Sale

  1. The Seller provides distance-selling services to Customers.
  2. Under the Sales Contract, the Seller undertakes to transfer ownership of the Products to the Customer, while the Customer undertakes to accept the Products and pay the applicable price.
  3. The Seller may conduct promotional campaigns involving temporary price reductions until a specified date or until the available quantity is exhausted.
  4. The Seller undertakes to provide Products free from defects.
  5. The Sales Contract is concluded when the Seller confirms the Customer's order.
  6. Products are dispatched or made available within the period indicated in their Product descriptions.
  7. The fulfilment period may be adjusted if the Customer modifies the order.
  8. Products may be delivered by a Delivery Company, delivered to a Parcel Locker or collected personally where such options are offered.
  9. Personal collection, where available, takes place on Business Days between 8:00 AM and 4:00 PM.
  10. Available delivery methods, Delivery Companies and related costs are displayed on the Shop website and during checkout.
  11. Products are released only after the required payment has been received.
  12. The Seller may send the Customer an email confirming that the order has been handed over to the Delivery Company.
  13. The risk of accidental loss or damage passes to the Customer when the Product is delivered to the Customer.
  14. Customers are advised to inspect parcels when receiving them.
  15. If a parcel is visibly damaged, the Customer may request preparation of an appropriate damage report.

Payments

  1. The amount payable is based on the Product prices displayed on the Shop website when the order is placed.
  2. Displayed Product prices are gross prices expressed in Polish zlotys and include VAT. Delivery and payment-related charges may be added separately.
  3. Applicable transaction and Delivery Costs are borne by the Customer.
  4. The total order amount shown before checkout confirmation includes Product prices, applicable taxes and additional charges connected with delivery or payment.
  5. The total order price confirmed at checkout is binding on both the Seller and the Customer.
  6. Available payment methods are displayed through the Shop.
  7. If cash payment is selected, payment is due when the Product is released.
  8. If bank transfer is selected, payment must be made within 7 days.
  9. If an external electronic payment provider is selected, payment is made when the order is placed.
  10. Where a refund is due, it will be processed without unnecessary delay and no later than fourteen (14) days from the date on which the reason for the refund arose.
  11. Refunds are made using the same payment method used for the original transaction unless the Customer agrees to another method that does not generate additional costs.
  12. The Seller is not required to refund additional delivery costs resulting from selection of a delivery option more expensive than the cheapest standard method offered by the Seller.

Newsletter

  1. The Newsletter Service consists of sending commercial information to the email address supplied by the Customer.
  2. The Newsletter may be subscribed to through a dedicated subscription field or another form made available through the Shop.
  3. Providing an email address is voluntary but necessary to receive the Newsletter.
  4. The Customer may voluntarily consent to processing of personal data for marketing purposes.
  5. Such marketing may include commercial information sent to the Customer's contact details.
  6. Marketing consent may be withdrawn at any time.
  7. The Newsletter agreement is concluded for an indefinite period when the Seller confirms subscription.
  8. The Customer may unsubscribe at any time without giving a reason by using the unsubscribe link or by contacting the Seller.

Complaints

  1. Complaints may be submitted under the statutory guarantee or under a separate guarantee where one applies.
  2. If a Product is covered by a separate guarantee, the Customer may submit a claim to the Seller or directly to the guarantee provider.
  3. Rights under a separate guarantee are independent from rights available under the statutory guarantee.
  4. Complaints may be submitted by traditional mail or email using the Seller's contact details.
  5. The complaint should contain contact details, information necessary to identify the Customer, a description of the problem and, where necessary, bank account details for a refund.
  6. If examination of a Product is necessary, the Customer must deliver it to the Seller unless its nature makes normal delivery excessively difficult.
  7. Complaints under the statutory guarantee are reviewed within fourteen (14) days from receipt.
  8. Complaints under a separate guarantee are reviewed within the period specified by the terms of that guarantee.
  9. The Customer will be informed about the outcome by email or traditional mail.
  10. If the Product must be returned to the Customer after the complaint has been resolved, it will be delivered to the Customer's address.
  11. Any monetary compensation will be paid using the method agreed with the Customer.
  12. Customers who are not Consumers are excluded from rights under the statutory guarantee where permitted by applicable law.

Out-of-Court Complaint Settlement

A Consumer may use available out-of-court complaint and dispute resolution procedures, including assistance from consumer courts, Trade Inspection bodies, Regional or Municipal Consumer Ombudsmen and organisations involved in consumer protection.

Additional information regarding available consumer dispute resolution procedures may be obtained through the Office of Competition and Consumer Protection.

Withdrawal from the Contract

  1. A Consumer may withdraw from a Contract, including a Sales Contract, within fourteen (14) days without providing a reason, subject to applicable exclusions.
  2. The Consumer may exercise this right by submitting a clear statement informing the Seller of the decision to withdraw.
  3. The model withdrawal form provided below may be used, but its use is not mandatory.
  4. The Product must be returned without unnecessary delay and no later than fourteen (14) days after the Consumer informs the Seller about withdrawal.
  5. The return deadline is met if the Product is dispatched before the fourteen-day period expires.
  6. The Consumer is responsible for any reduction in the Product's value caused by handling beyond what is necessary to determine its nature, characteristics and functioning.
  7. Following valid withdrawal, the Contract is considered not concluded.

Data Processing and Cookies

Information concerning processing of personal data and the rights of persons whose data is processed by the Seller is provided in the Shop's Privacy and Cookie Policy.

Detailed information concerning cookies used by the Shop is also available in the Privacy and Cookie Policy.

Licence Conditions

  1. The Seller grants Customers a royalty-free licence to use the Shop for private purposes in accordance with these Rules and Regulations.
  2. The Shop's name, design, structure, source code, webpages, documents, Rules and Regulations and other materials connected with operation of the Shop may be protected by copyright.
  3. The licence permits Customers to access, display and use the Shop on telecommunications devices for their own purposes.
  4. Customers may not rent, lease, resell, modify or create derivative versions of protected Shop materials or remove copyright or ownership information.
  5. The licence is non-exclusive and unlimited in time and territory.
  6. By publishing reviews, comments or other content through the Shop, the Customer grants the Seller a free, non-exclusive and territorially unlimited licence to use that content for operation and presentation of the Shop.
  7. Customers must not publish unlawful, misleading, offensive or infringing material or content promoting racism, xenophobia, hatred, illegal drug use or other prohibited activities.
  8. The Seller may remove or moderate content that violates these Rules and Regulations.

Changes to the Rules and Regulations

  1. These Rules and Regulations enter into force three (3) days after they are published on the Shop website.
  2. Changes in applicable law or technical or organisational circumstances may require amendments to these Rules and Regulations.
  3. Changes are introduced by publishing an updated version through the Shop.
  4. Changes do not apply to Sales Contracts concluded before the new version enters into force.
  5. Information about changes will be published at least three (3) days before they become effective.
  6. Where a Customer is bound by an agreement for an indefinite period, information concerning changes may also be sent by email.

Final Provisions

  1. Capitalised expressions used in these Rules and Regulations have the meanings provided in the Definitions section.
  2. The Seller is not responsible for interruptions affecting Customers who are not Consumers where such interruptions result from force majeure, necessary technical work or circumstances attributable to third-party service providers.
  3. The Seller is not responsible for lost profits or opportunity costs suffered by Customers who are not Consumers.
  4. Where permitted by applicable law, disputes involving Customers who are not Consumers will be heard by the court having jurisdiction over the Seller's registered office.
  5. Where permitted by applicable law, contracts with the Seller are governed by the law of the Republic of Poland.
  6. Nothing contained in these Rules and Regulations is intended to exclude or restrict mandatory rights granted to Consumers.
  7. If mandatory consumer laws applicable in the Consumer's country conflict with these Rules and Regulations, the mandatory provisions of law prevail.
  8. If any provision of these Rules and Regulations is invalid or ineffective, the remaining provisions remain valid.

Definitions

Business Days means Monday through Friday, excluding public holidays.

Delivery means delivery of Products to the destination specified by the Customer with the assistance of a Delivery Company.

Customer means a natural person, legal person or organisational entity that concludes a contract with the Seller in accordance with applicable law.

Customer Account means the panel available to a registered and logged-in Customer that allows management of orders and related information.

Consumer means a natural person entering into a contract for purposes not directly connected with their business or professional activity.

Basket means the Shop function that allows Products selected for purchase to be collected before checkout.

Delivery Company means an entity cooperating with the Seller in connection with delivery of Products.

Seller means the Shop operated through https://scapha.com/.

Sale means a Service consisting of selling Products to Customers and transferring the relevant rights to those Products in exchange for payment of the stated price.

Products means goods presented for sale through the Shop.

Service means a service provided by the Seller to the Customer under a contract concluded remotely through the Shop.

Rules and Regulations means these contractual terms governing Services provided electronically through the Shop.


INFORMATION ON THE RIGHT TO WITHDRAW FROM THE CONTRACT

Contract Withdrawal Instructions

As a Consumer, you have the right to withdraw from a Contract concluded with our Shop within fourteen (14) days without giving a reason, subject to situations where the right of withdrawal is excluded by law.

The fourteen-day period is calculated from the date on which you, or a third party designated by you other than the Delivery Company, physically receives the goods.

If an order contains several goods delivered separately, the period begins when the final item is received.

If goods are delivered in several lots or parts, the period begins when the final lot or part is received.

For contracts providing for regular delivery of goods, the period begins when the first item is received.

For Service contracts, the fourteen-day period begins on the date the Contract is concluded.

To meet the withdrawal deadline, it is sufficient to send your statement before the applicable fourteen-day period expires.

If you wish to exercise the right to withdraw, you must inform:

Your withdrawal must be communicated through a clear statement, for example by traditional mail or email.

You may use the withdrawal form below, although its use is not required.

Effects of Withdrawal

If you withdraw from the Contract, all payments received from you will be refunded, including standard delivery costs. Additional costs resulting from your choice of a delivery method more expensive than the cheapest standard option offered by us are not refundable.

The refund will be processed without unnecessary delay and no later than fourteen (14) days after we are informed of your decision to withdraw.

Refunds will be made using the same payment method used for the original transaction unless you expressly agree to another method. No additional refund fee will be charged.

We may withhold the refund until we receive the returned goods or until you provide proof that the goods have been sent back, whichever occurs first.

Please send returned goods without unnecessary delay, and no later than fourteen (14) days after informing us about your withdrawal, to:

The deadline is met if the goods are dispatched before the fourteen-day return period expires.

The Customer is responsible for direct costs associated with returning the goods.

The Customer is responsible only for a reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.

Exclusion of the Right to Withdraw

The right to withdraw from a distance contract does not apply to non-prefabricated Products manufactured according to the Customer's specifications or Products intended to satisfy the Customer's individual needs.

Seller's Information

Products may be covered by a guarantee provided by the manufacturer or distributor. Where such a guarantee applies, the Customer may submit a complaint directly to the guarantee provider or through the Seller.

Rights under a manufacturer's or distributor's guarantee do not restrict the Customer's rights arising under the statutory guarantee for Product defects.
